Welcome to EggerMath. These Terms of Service ("Terms") govern your access to and use of the EggerMath website at eggermath.com and all associated services, features, and content (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
EggerMath provides a free, browser-based Game Boy Advance emulator built on the open-source mGBA engine compiled to WebAssembly. The Service allows users to play Game Boy Advance (GBA), Game Boy (GB), and Game Boy Color (GBC) games directly in their web browser. Users may upload their own ROM files from their local device to be loaded into the emulator. The emulator runs entirely client-side in your browser; no game data is transmitted to or stored on our servers.
You must be at least 13 years of age (or 16 years of age in the European Economic Area) to use the Service. By using the Service, you represent and warrant that you meet these age requirements and have the legal capacity to enter into these Terms.
EggerMath does not require user accounts or registration. The Service operates entirely without sign-up. You are solely responsible for maintaining the confidentiality of your device and browser. We are not responsible for any unauthorized access to your local data.
EggerMath does not provide, host, distribute, sell, or facilitate the acquisition of ROM files or any copyrighted game content. All ROM files are uploaded by you from your own local device. You are solely responsible for ensuring that any ROM files you use are lawfully obtained and that your use of such files complies with all applicable laws and regulations, including intellectual property laws.

We reserve the right to suspend or terminate access to the Service for any user who, in our sole discretion, appears to be using the Service in connection with infringing content.

The mGBA emulator engine is open-source software licensed under the Mozilla Public License 2.0 (MPL 2.0). The EggerMath website design, code, branding, logos, and all original content are owned by EggerMath and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license to use it as described herein.
You may not use our name, logo, or branding without prior written consent. Any unauthorized use of our intellectual property is strictly prohibited.
EggerMath respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content accessible through the Service infringes your copyright, please submit a DMCA takedown request in accordance with our DMCA Takedown Policy. We will promptly investigate and respond to all valid DMCA notifications.

The Service may contain links to third-party websites, services, or resources, including MEGA cloud storage from which certain game files may be loaded. We are not responsible for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any loss or damage caused by your use of or reliance on any third-party content or services.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EGGERMATH, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS (WHICH IS ZERO, AS THE SERVICE IS FREE); OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless EggerMath and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you upload or transmit through the Service.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
We may suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to us, other users, or third parties, or for any other reason. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including Sections 6, 9, 10, 11, and 15.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via a banner on the website. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, any disputes shall be submitted to the exclusive jurisdiction of the courts of competent jurisdiction in the United States.
If you are a consumer in the European Union, you may also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your statutory rights as a consumer.
