DMCA Takedown Policy

Report copyright infringement and request content removal

1. Overview

EggerMath respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

EggerMath is a browser-based emulator that runs entirely on the user's device via WebAssembly. We do not host, store, cache, or distribute ROM files or any copyrighted game content on our servers. Users upload ROM files directly from their local devices into the browser emulator, and these files are never transmitted to or stored by EggerMath. This means that in most cases, we are technically unable to remove specific user-uploaded content, as it exists only on the user's own device.

However, we are committed to taking appropriate action where possible, including disabling access to our Service for users who repeatedly infringe copyrights.

2. Designated Copyright Agent

We strongly prefer that you submit your notice via email. Physical mail may experience significant delays in processing.

3. Filing a DMCA Takedown Request

To file a valid DMCA takedown request, your notification must include all of the following information. Incomplete requests may be delayed or rejected:

  • Identification of the copyrighted work — A clear and specific description of the copyrighted work you claim has been infringed. If multiple copyrighted works are involved, you may provide a representative list.
  • Identification of the infringing material — The specific URL(s) on EggerMath where the allegedly infringing material is located. Please provide as much detail as possible so we can identify the material in question.
  • Your contact information — Your full legal name, mailing address, telephone number, and email address.
  • Good faith statement — A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  • Accuracy statement under penalty of perjury — A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Signature — Your physical or electronic signature (a typed full name at the bottom of the notification is sufficient for electronic submissions).

You may use the form below to submit your request, or you may send a complete DMCA notice directly to our copyright agent via email.

4. Submit a Takedown Request

Fill out the form below to submit a DMCA takedown request. All fields marked with an asterisk (*) are required.

5. Response Timeline

Upon receiving a valid DMCA takedown request, we will:

  • Acknowledge receipt — We will confirm receipt of your request within 1 business day.
  • Review and assess — We will review your request for completeness and validity within 3-5 business days.
  • Take action — If your request is valid, we will take appropriate action, which may include disabling access to the relevant content or suspending the offending user's access to the Service.
  • Notify you — We will notify you of the outcome of our review and any actions taken.

Please note that because the emulator runs entirely in the user's browser, we may be technically limited in our ability to remove specific content. In such cases, we will take alternative appropriate actions, such as disabling the user's access to our Service.

6. Counter-Notification Process

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must include:

  • Your full legal name, mailing address, telephone number, and email address
  • Identification of the material that was removed or disabled and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your consent to the jurisdiction of the federal court in your district (or, if you are outside the United States, the jurisdiction of any federal court in which the Service provider may be found)
  • Your physical or electronic signature

Send your counter-notification to our designated copyright agent at htcprom@gmail.com with the subject line "DMCA Counter-Notification."

Upon receiving a valid counter-notification, we will forward it to the original complainant. The original complainant then has 10 business days to file a court action seeking to restrain the allegedly infringing activity. If no court action is filed within 10 business days, we may restore the removed content.

7. Repeat Infringer Policy

EggerMath maintains a policy of terminating the accounts and access rights of users who are identified as repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice or who has had content removed more than twice under the DMCA.

We reserve the right to terminate access to the Service, without notice, for any user who we determine in our sole discretion to be a repeat infringer. Termination decisions are made on a case-by-case basis and take into account all relevant circumstances, including the severity of the infringement and the user's overall history of compliance.

8. Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We reserve the right to pursue legal remedies against any party that submits a fraudulent or bad-faith DMCA notification or counter-notification.

9. Good Faith and Educational Use

EggerMath is an educational project that provides an open-source emulator for research, preservation, and personal use. We encourage all users to respect intellectual property rights and to use only ROM files that they legally own. We comply promptly with all valid DMCA requests and cooperate fully with copyright holders to resolve legitimate concerns.
